There have been countless hours with Congressman, Legislation, Town Officials, Radio and TV appearances that have been spent this year by your leadership. We have been successful on several fronts. As you know electrification has been delayed and will hopefully die on the vine with proposed federal legislation. The sprinkler systems although implemented are limited to townhomes buildings above three units and above but providing that option for those consumers building a new home below that height. The estimated increased cost to sprinkle a home is between $20,000 and $30,000. This would have put a big dent in any momentum for new home construction here in WNY.
Gas Ban Suspended
In a major victory in the long legal battle over New York’s statewide gas ban for new homes, NAHB and the New York State Builders Association (NYSBA) have secured a suspension of the new regulations while the case works through the appeals process.
After extensive negotiation, attorneys for the state agreed to a stipulation suspending implementation of a state law passed in 2023 that bans the use of natural gas in any new construction of under seven stories, including homes, beginning Jan. 1, 2026.
If NAHB and NYSBA are unsuccessful in the appeal, the state has agreed to a 120-day grace period before the gas ban is effective.
NAHB and NYSBA also recently sent a letter to U.S. Attorney General Pam Bondi asking her office to take action on the gas ban.
NAHB is opposed to blanket bans on energy sources in residential construction. Natural gas bans, while well intended for environmental impact, limit consumer choice and can lead to higher utility bills. Gas bans also have the unintended consequence of placing additional strain on a national electric grid already buckling under the recent surge of data center construction in the U.S.

Bologna Calls Out Democrats for Blocking Energy Affordability Bill as Housing and Grid Pressures Mount
Assemblyman Paul Bologna (R,C–Clarence) on 4/30 blasted members of the New York State Assembly Standing Committee on Energy after the Democrat Majority voted to block two bills, one sponsored by Bologna and another by Assemblyman Phil Palmesano (R,C-Corning), which would repeal the state’s All-Electric Buildings Act.
The legislation was held in committee, preventing it from advancing to a full vote of the Assembly.
